Finance agreements are a category of documents that provide the legal structure for meeting project costs. Depending on the size and structure of the project, equity and/or debt financing encompassing a broad spectrum of often complex legal agreements may be required. Finance agreements can be bilateral or multilateral, and can involve a variety of financial institutions, including international financial institutions (IFIs). Obtaining sufficient financing is usually contingent upon having other legal documents in place (e.g. a power purchase agreement). Normally, it will be the lender who insists on a suite of legal documents of their own choosing, as it is the lender assuming the financial risk. In this case, it is especially critical to have your own counsel review the documents.
