Real property issues are among the most important preliminary considerations of a clean energy project, and can include issues such as project siting, land surveys, acquiring interests in land (purchase, lease, and/or easement), land title and title insurance, green leasing (detailed in the next section), permitting and approvals, zoning/land use, mineral/water rights, and securing access to essential resources. Each component of real property may require specific legal documents. For example, a resource acquisition agreement secures the supply of an essential project resource and might be included as part of a land lease, purchase, or easement agreement. In the context of a clean energy project, the subject of resource acquisition agreements might be water rights (e.g. for hydroelectric power generation), geothermal heat source, or unimpeded access to the wind.
